Terms of service

Introduction

These Terms of Service govern your use of YoloWiz at yolowiz.com (the “Service”), operated by YoloWiz LLC. By accessing or using the Service you agree to be bound by these Terms. Please read them carefully.

Our role

YoloWiz LLC operates a travel search and aggregation platform. We display travel options — flights, places to stay, things to do, car rental and cruises — and, where available, link you to the third-party provider who sells them. Some of those links earn us a commission from the seller, as described in our affiliate disclosure; it never changes the price you pay.

We act solely as a search and aggregation platform. We are not a travel agent, a tour operator, or a party to any booking or transaction you make with a third-party provider. Any booking you make is directly with that provider, and their terms and conditions apply to it. We do not endorse or make representations about the quality, safety, or legality of any travel option or service offered by a third-party provider.

Prices and availability

Flight fares shown on YoloWiz come from third-party data providers and change constantly. A fare displayed in search results is an indication, not an offer: the price you are ultimately charged is set by the seller you book with, and may differ.

Booking is completed on the seller’s own website under their terms. We are not a party to it. Flight, hotel and things-to-do results are live prices from third-party providers; car and cruise results remain demonstration data and are not bookable, and are labelled as such where they appear.

Supplier terms

Every booking you reach through YoloWiz is sold by a third-party supplier — an airline, a property, a tour operator, a booking site — under that supplier’s own terms, including its prices, taxes and fees, cancellation and refund policies, age and identification requirements, and any rules specific to the fare, room or ticket you choose. Those terms are between you and the supplier. Read them before you buy: a restriction that matters to you (a non-refundable rate, a change fee, a check-in cutoff) lives there, not here.

Because we are not a party to the transaction, we are not responsible for a supplier’s acts or omissions — including overbookings, schedule changes, cancellations, service quality, or the accuracy of what a supplier publishes about its own products. Suppliers may also limit their own liability under their terms; those limitations apply to your booking independently of anything written here.

Travel documents and requirements

You are responsible for making sure everyone travelling has the documents their trip requires — passports with sufficient validity, visas, and any health or entry requirements of the places you visit or transit. Requirements change and vary by nationality; confirm them with the relevant government or embassy before you travel. YoloWizdisplays travel options and does not check documents or eligibility for you.

Your account

Some features require an account. You are responsible for keeping your email address and password confidential, and for all activity that occurs under your account. Searching does not require an account.

You agree to notify us immediately of any unauthorised use of your account or any other breach of security. We are not liable for loss or damage arising from your failure to meet this obligation.

You agree to provide accurate, current and complete information when registering, and to keep it up to date.

Acceptable use

You agree to use the Service only for lawful purposes, and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of it. You agree not to:

• Scrape, spider, or use any robot or automated process to monitor or copy any part of the Service, except as permitted by our robots.txt.
• Attempt to gain unauthorised access to any part of the Service, or to any systems or networks connected to it, by hacking, password mining, or other illegitimate means.
• Use the Service in any way that could damage, disable, overburden, or impair it, or interfere with anyone else's use of it.
• Use the Service for any illegal or unauthorised purpose.

We may suspend or terminate your account and access to the Service if you breach these Terms.

Intellectual property

All content, trademarks, service marks, trade names, logos, and other intellectual property displayed on the Service are the property of YoloWiz LLC or its licensors, and are protected by applicable intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any of it without our express written permission.

If you believe content on the Service infringes your copyright, send a notice to support@yolowiz.com identifying the work, the material you believe infringes it and where it appears, your contact details, and a statement that you believe in good faith the use is unauthorised. We review such notices promptly and remove or disable material where appropriate.

Accuracy of information

Prices, availability, and other travel information are supplied by third-party providers and change constantly. While we aim to keep what we display accurate and current, we cannot guarantee the accuracy, completeness, or reliability of information provided by third parties, and you acknowledge that it may contain inaccuracies or errors.

No warranty

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, YoloWiz LLC and its affiliates, directors, employees, agents, suppliers and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — resulting from (i) your access to, use of, or inability to use the Service; (ii) the conduct or content of any third party on the Service; (iii) any content obtained from the Service; or (iv) unauthorised access to or alteration of your transmissions or content. This applies whether the claim is based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we were advised of the possibility of such damage, and even if a remedy set out here is found to have failed of its essential purpose.

Indemnification

You agree to defend, indemnify and hold harmless YoloWiz LLC, its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any claims, damages, obligations, losses, liabilities, costs and expenses (including legal fees) arising out of (a) your use of the Service, by you or anyone using your account and password, or (b) your breach of these Terms.

Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions.

Any dispute, controversy or claim arising out of or relating to these Terms — including their breach, termination or validity — shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration is Des Moines, Iowa, but either party may elect to attend any hearing remotely by video or telephone, and we will not oppose such an election. The award rendered by the arbitrator shall be final and binding, and judgment may be entered on it in any court of competent jurisdiction.

This section does not take away your right to bring an individual claim in small claims court, wherever you live, if your claim qualifies there — and it does not prevent either party from seeking emergency injunctive relief from a court where genuinely necessary to protect intellectual property or the security of the Service.

General

If any provision of these Terms is found unenforceable, the rest remain in effect, and the unenforceable provision is read as narrowly as needed to make it enforceable. Our not enforcing a provision on one occasion is not a waiver of it. You may not assign your rights under these Terms; we may assign ours as part of a merger, acquisition or sale of assets, and will note any such change here. These Terms, together with our Privacy Policy and Affiliate Disclosure, are the entire agreement between you and YoloWiz LLC about the Service.

Changes to these Terms

We may modify or replace these Terms at any time. If a revision is material we will give at least 30 days’ notice before the new terms take effect. By continuing to use the Service after revisions take effect, you agree to be bound by them. If you do not agree, please stop using the Service.
